Court finds the ACMA can investigate 2Day FM

2Day FM has lost it’s attempt to stop the ACMA from further investigating the station to find evidence that it broke the law when it broadcast the now infamous royal prank call last year.
 
The ACMA believes 2Day breached the licence condition that states a licensee must not use its broadcasting service in the commission of an offence.
 
2Day had argued that determining whether a criminal offence had been committed was for the courts to decide, not of the ACMA. On Thursday, Federal Court Justice Richard Edmonds dismissed the application.
 
The station has only been successful in having the ACMA report suppressed for two weeks whilst it considered it’s options for appeal.
 
It’s been a tough week for Southern Cross Austereo, as this announcement comes on top of the news that Kyle & Jackie O are leaving 2Day FM, potentially putting Southern Cross Media’s share price and revenue at risk.
